Expanded Parole in Place is a new initiative announced by the Biden-Harris administration that allows eligible undocumented spouses and stepchildren of US citizens to apply for lawful permanent status without leaving the country.
On August 26th there was a court ruling in Texas that prevents USCIS from granting Prole in Place. While immigration cannot approve applications, individuals can still
submit their applications, if eligible.
You may be eligible for Parole in Place (PIP) if you are an individual who:
- Is present in the US without admission or parole;
- Has been legally married to a US citizen as of June 17, 2024; AND
- Has been continuously and physically present in the US for at least 10 years as of June 17, 2024.
OR
If you are a stepchild of US citizen who:
- Has been physically present in the US without inspection;
- Is unmarried
- Is under the age of 21; AND
- Were under the age of 18 when their undocumented parent married their US citizen stepparent.
